IT IS SOLELY YOUR RESPONSIBILITY TO ENSURE THAT ONLINE CASINOS AND GAMBLING ARE LEGAL WHERE YOU RESIDE. CASINORATINGCLUB.COM MAKES NO REPRESENTATIONS THAT GAMBLING IS LEGAL IN YOUR COUNTRY, STATE OR REGION.
PLEASE READ THE ENTIRE AGREEMENT SET OUT IN THE PAGES BELOW.
OUR GOAL:
CasinoRatingClub.com wants to reward our members, as evaluators, for providing subjective ratings of online casinos. These casinos have either requested a rating from CasinoRatingClub.com or are being rated by us.
CasinoRatingClub.com's goal is to deliver more sophisticated information to potential visitors of our rated casino sites prior to making a decision to become a member.
You must carefully read the following Terms and Conditions of your membership in CasinoRatingClub.com. These Terms and Conditions contain important information that effect your membership and how you can earn money.
You ("You" or "Member") must complete the Membership Form and read and agree to the Terms and Conditions of this Agreement ("Agreement") by joining CasinoRatingClub.com."
IF YOU DO NOT AGREE TO ALL THE TERMS OF THIS AGREEMENT INCLUDING THE PRIVACY POLICY, CASINORATINGCLUB.COM IS UNWILLING TO OFFER YOU THIS SERVICE AND YOU SHOULD LEAVE THE SITE.
CasinoRatingClub.com, a Costa Rica corporation, ("CasinoRatingClub.com" or "we") may revise the Terms and Conditions of this "Membership Agreement" from time to time, at our sole discretion, by updating this posting.
Unless otherwise provided below, the revised terms will take effect when they are posted. Your continued use of the Service will signify your acceptance to the modified terms. Please review the terms on this website frequently to look for changes.
A. BASIC REQUIREMENTS FOR MEMBERSHIP. To maintain a Membership in the CasinoRatingClub.com Service, you must meet the following requirements - and we reserve the right to terminate the Membership of anyone who fails to meet these requirements on an ongoing basis:
A) 1. You must be at least 21 years of age or older to participate.
A) 2. You must not become a member if gambling in your country, state or region is prohibited by law.
A) 3a. ONE ACCOUNT PER MEMBER. You may only sign up once and maintain one Membership in the Service. CasinoRatingClub.com reserves the right to terminate duplicate accounts, resulting in the potential loss of accumulated earnings.
A) 3b. ONE ACCOUNT PER FAMILY - Only 1 member of any family or household is eligible.
A) 4. PROVIDE ACCURATE INFORMATION. You must provide CasinoRatingClub.com with valid contact and residential information and promptly update such information should it change or should additional information be required by CasinoRatingClub.com for legitimate tax-related purposes or any other reason required by applicable law. CasinoRatingClub.com reserves the right to request verification of, and member agrees to be subject to verification of, any of the information provided by member for enrollment with and continued use of the services provided by CasinoRatingClub.com You may not impersonate or misrepresent your identity. We reserve the right to terminate any account, and associated membership, containing untruthful information. CasinoRatingClub.com is not responsible for lost payments or communications due to your failure to provide valid contact information as reasonably necessary.
A) 5. ENROLLMENT. To the full extent allowed by applicable law, CasinoRatingClub.com at its sole discretion and for any or no reason may refuse to accept applications for membership.
A) 6. CASINORATINGCLUB.COM NEWSLETTER AND OTHER EMAILS. By signing up for CasinoRatingClub.com, you are opting-in to receive CasinoRatingClub.com newsletters and other special offer emails. If you do not wish to receive these emails, you may opt-out at any time, by updating your Account Info.
A) 7. ACCOUNTS ARE NON-TRANSFERABLE. Your password and account are personal to you and are not transferable; You may not allow anyone else to use your password or account or to receive payments to you; You may not use anyone else's password or account or act to accrue earnings for anyone else's account; You are responsible for keeping Your password secret. CasinoRatingClub.com will not be liable for losses that are incurred through the use of your password by a third party or the disclosure of your password or account.
A) 8. TERMINATION AND CANCELLATION. CasinoRatingClub.com at its sole discretion and for any reason or no reason at all may terminate any Members without prior notice for:
(a) any violation of any provision of this Agreement;
(b) aiding in or promoting circumvention of the CasinoRatingClub.com Service;
(c) acting against the business interests or reputation of CasinoRatingClub.com;
(d) otherwise acting unlawfully in relationship to CasinoRatingClub.com, the CasinoRatingClub.com website or the CasinoRatingClub.com service;
(e) breach of our Spamming Policy;
(f) inactivity (defined as the failure to earn any cash from CasinoRatingClub.com) for a continuous six-month period; or,
(g) Any actual or suspected form of cheating; or
(h) any other reason at the sole discretion of CasinoRatingClub.com. If your account is terminated by CasinoRatingClub.com, you may not re-enroll or join under a new account unless formally invited to do so by CasinoRatingClub.com. (See Section I. below for more information about termination of accounts.) You may cancel your Membership at anytime by notifying CasinoRatingClub.com at info@CasinoRatingClub.com. If you decide to cancel your membership and later wish to re-enroll, you will be assigned a new account username and password number and you will not receive credit for evaluations you made using your previous username and password.
Any member terminated by CasinoRatingClub.com will forfeit any unpaid rating fees.
B) YOUR RELATIONSHIP TO CASINORATINGCLUB.COM. By filling out the membership information, you are applying to receive a service. Your relationship to CasinoRatingClub.com is one of an independent contractor and/or customer. No employee-employer relationship is created by your use of the Service. You are fully responsible for filing local, state, or federal or any other taxes if applicable on any compensation received as a result of your participation in the service. When/If Your annual earnings through the CasinoRatingClub.com service reaches $250.00, CasinoRatingClub.com will request your Social Security number and other appropriate tax-related information to use to comply with federal and state tax regulations. CasinoRatingClub.com may not pay out credits earned in excess of the $250 limit without receiving this information from you.
C) RATING LIMITS. The number of ratings that will be credited to your account are limited from time to time ("Monthly Rating Limit") and we reserve the right to change the Monthly Rating Limit at any time by posting the new limit on the CasinoRatingClub.com website.
C) 1. RATES MAY CHANGE. The fee paid for casino ratings is subject to change. The current rates can be found on this page.
D) CURRENT RATING MODEL (EFFECTIVE AS OF JANUARY 22, 2002).
D) 1. CURRENT RATING FEE is based on membership level:
New Member Level:
Each approved rating pays $20.00. Once the first five casinos have been successfully rated, a $25.00 Bonus is paid. Therefore, new members receive $125.00 for rating their first 5 casinos ($20. per casino plus $25 bonus).
Silver Member Level:
Each approved rating pays $25.00 - from the 6th casino rated through to the 15th . At the 15th casino successfully rated, a $50. bonus is earned.
Gold Member Level:
Each approved rating pays $25. from the 16th through 30th casinos rated. There is a $100 bonus earned when the 30th casino has been rated by the member.
Platinum Member Level:
Each approved rating pays $30.
D) 2. EARNING YOUR RATING FEE
In order to earn cash for rating casinos you MUST abide by the following rules:
(a) YOU MAY ONLY EARN A "RATING FEE" BY PROVIDING RATING SERVICES FOR CASINOS WE HAVE REQUESTED THAT YOU RATE.
(b) From time to time you will be requested to rate casinos via email or you can visit our web site to view casinos that currently requiring rating. If you are requested by email or complete the rating request on our web site you MUST RECEIVE A "RATING REQUEST CONFIRMATION" email prior to proceeding with your rating.
(c) You must follow all instructions on the How It Works page.
(d) Please be aware UNDER NO CIRCUMSTANCES DOES THE CASINORATINGCLUB.COM ASSUME ANY RESPONSIBILITY FOR YOUR RELATIONSHIP WITH ANY CASINO, YOUR ACCOUNT, WINS, LOSSES, BONUSES OR ANY OTHER EXPERIENCE YOU MAY HAVE WITH A CASINO YOU ARE RATING FOR THE BENEFIT OF OUR MEMBERS. If for any reason you are dissatisfied with your casino experience, your rating form is the place to advise us and others of your less than satisfactory experience.
(e) Under no circumstances can you earn a rating fee for rating the same casino more than once.
D) 3. CLAIMING YOUR RATING FEE

IT IS YOUR SOLE RESPONSIBILITY TO ENSURE YOU OBTAIN, RETAIN AND FORWARD ALL INFORMATION NECESSARY TO CLAIM YOUR RATING FEE.
E) REFER-A-FRIEND WEBMASTER PROGRAM.
CasinoRatingClub.com grants you a limited license to use the CasinoRatingClub.com trademarks and tradename as described on the Webmaster Program page solely for the purpose of seeking legitimate referrals to the CasinoRatingClub.com site. This license is subject to the terms and conditions of our trademark policy set out on the Webmaster Program page which may be varied by CasinoRatingClub.com from time to time. All use of the CasinoRatingClub.com trademarks and trade names shall be for the sole benefit of CasinoRatingClub.com and you hereby agree to assign and do all things necessary to ensure that CasinoRatingClub.com receives the benefit of such use or required by CasinoRatingClub.com to protect its trademarks. CasinoRatingClub.com also reserves the right to revoke this license on a selective basis. Improper use of the trademarks and/or tradename of CasinoRatingClub.com is strictly prohibited and CasinoRatingClub.com may terminate the account or cancel the membership of anyone who violates this policy.
E) 1. No benefits are available to members for referrals of advertisers to CasinoRatingClub.com.
E) 2. MEMBERS MAY NOT USE SPAM TO OBTAIN REFERRALS. You may not use unsolicited email, usenet, or message board postings ("SPAM") to gather referrals. (Usenet and message board spam are messages sent or posted which are unrelated to the topic of discussion of the particular news group or message board.)
The use of spam to promote the CasinoRatingClub.com service has strict negative consequences. Not only may CasinoRatingClub.com terminate the Membership of any Member who in CasinoRatingClub.com's reasonable opinion has used unsolicited email to gain referrals (a "Spammer"); CasinoRatingClub.com will also sever the branch of the "referral tree" made up of direct and extended referrals obtained by the Spammer. The branch accounts (those under the Spammer) will not be terminated, but no one above the Spammer on the referral tree will benefit from them. In addition, you may be subject to state and federal penalties or other legal consequences under applicable law if you send unsolicited email. Our Anti-Spam Policy provides more details and is incorporated into this Agreement.
F) MAILING OF CHECKS.
Currently, the only way to receive compensation from CasinoRatingClub.com is by check mailed to the mailing address provided by you in the membership form. In the future, CasinoRatingClub.com may initiate alternative methods of payment (e.g. credit to a credit card) and reserves the right to charge a fee for continued mailing of checks after that time. Subject to the limitations herein, CasinoRatingClub.com will mail a check to you within a reasonable time after you have rated a minimum of two casinos and provided the necessary information as described in Section D. of this agreement.
G. MONITORING YOUR ACCOUNT BALANCE.
Monitoring amounts due to you is your sole responsibility and is subject to the reporting requirements of CasinoRatingClub.com as they currently exist and as they are amended from time to time.
H. YOUR RELATIONSHIP WITH EVALUATED CASINOS.
Your relationship with evaluated casinos whether emailed to you from CasinoRatingClub.com or accessed by you from our website is strictly between you and the evaluated casino. CasinoRatingClub.com assumes no responsibility for repayment of initial deposits, special casino offers or bonuses or other programs, offerings or special awards as may be included in rated casino offerings.
I. TERMINATION.
If a Member's account is terminated by CasinoRatingClub.com, CasinoRatingClub.com may refuse to pay some or all of the amounts credited to the terminated Member's account if such amounts were earned in violation, or after violation, of this Agreement or were otherwise unlawfully obtained by the Member. Similarly, CasinoRatingClub.com will have no obligation to pay a Member for amounts credited to the Member's account that were earned in violation or after violation of this Agreement by any of the Member's direct or extended referrals. If your account is terminated by CasinoRatingClub.com, You may not re-enroll or join under a new account unless formally invited to do so by CasinoRatingClub.com.
J. DISCLAIMER OF WARRANTIES.
YOU EXPRESSLY AGREE THAT USE OF THE SERVICE IS AT YOUR SOLE RISK. THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE MAXIMUM EXTENT ALLOWED BY APPLICABLE LAW, CASINORATINGCLUB.COM EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED BY LAW, CUSTOM OR OTHERWISE, INCLUDING WITHOUT LIMITATION ANY WARRANTY OF MERCHANTABILITY, SATISFACTORY QUALITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT. CASINORATINGCLUB.COM MAKES NO WARRANTY REGARDING ANY GOODS OR SERVICES PURCHASED OR OBTAINED THROUGH THE SERVICE OR ANY TRANSACTIONS ENTERED INTO THROUGH THE SERVICE.
K. LIMITATION OF LIABILITY.
TO THE MAXIMUM EXTENT ALLOWED BY APPLICABLE LAW, NEITHER CASINORATINGCLUB.COM NOR ANY OF ITS MEMBERS, SUBSIDIARIES, AFFILIATES, SERVICE PROVIDERS, LICENSORS, OFFICERS, DIRECTORS OR EMPLOYEES SHALL BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR RELATING TO THIS AGREEMENT, RESULTING FROM THE USE OR THE INABILITY TO USE THE SERVICE OR FOR THE COST OF PROCUREMENT OF SUBSTITUTE GOODS AND SERVICES OR RESULTING FROM ANY GOODS OR SERVICES PURCHASED OR OBTAINED OR MESSAGES RECEIVED OR TRANSACTIONS ENTERED INTO THROUGH THE SERVICE OR RESULTING FROM UNAUTHORIZED ACCESS TO OR ALTERATION OF USER'S TRANSMISSIONS OR DATA, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, USE, DATA OR OTHER INTANGIBLE, EVEN IF SUCH PARTY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT WILL CASINORATINGCLUB.COM'S TOTAL CUMULATIVE LIABILITY TO ANY MEMBER UNDER THIS AGREEMENT EXCEED AN AMOUNT EQUAL TO: THE NUMBER OF PAID SEARCHES THAT THE MEMBER PERSONALLY COMMITTED DURING THE IMMEDIATELY PRECEDING TWO MONTHS, MULTIPLIED BY THE MAXIMUM PAYOUT RATE PER SEARCH AVAILABLE ON THE CASINORATINGCLUB.COM SERVICE DURING THAT SAME PERIOD PLUS THE SUM OF THE POSTED DOLLAR AMOUNTS EARNED FOR RESPONDING TO OFFERS DISPLAYED BY CASINORATINGCLUB.COM ON OUR PARTNER SITES AND ON CASINORATINGCLUB.COM.
M. GOVERNING LAW AND OTHER TERMS.
Any action related to this Agreement will be governed by Costa Rica law, excluding (1) principles of conflicts of laws, and (2) the United Nations Convention on Contracts for the International Sale of Goods. Any action relating to this Agreement shall be brought in the courts located in the Costa Rica, and You hereby submit to the exclusive jurisdiction and venue thereof. You agree to comply with the laws of the United States that apply to the use of this Service and the compensation You may receive. If the law of Your country, state, or province of residence prohibit or limit your participation in this Service, then You are responsible for complying with such laws and you agree to indemnify CasinoRatingClub.com against any breach. If any part of this Agreement is held to be unenforceable, the unenforceable part shall be given effect to the greatest extent possible and the remainder will remain in full force and effect. This Agreement is personal to you and you may not transfer, delegate, or assign this Agreement, your referral network, your CasinoRatingClub.com account or other benefits you receive as a CasinoRatingClub.com Member to anyone. Any attempt by you to assign or delegate this Agreement shall be null and void. CasinoRatingClub.com may assign this Agreement at its sole discretion.
N. SECURITY.
To prevent unauthorized access, maintain data accuracy, and ensure the correct use of information, CasinoRatingClub.com has used appropriate industry standard procedures to safeguard the confidentiality of Your personal information, such as firewall, encryption, token authentication, application proxies, monitoring technology, and adaptive analysis of network traffic to track abuse of our network and its data. However, no data transmitted over the Internet can be 100% secure. As a result, while we strive to protect your personal information, CasinoRatingClub.com cannot guarantee the security of any information that you transmit to us or from our sponsors and You do so at Your own risk.
This Agreement constitutes the entire Agreement between You and CasinoRatingClub.com in connection with general membership in CasinoRatingClub.com and supersedes all prior agreements between the parties regarding the subject matter contained herein. If any provision of this AGREEMENT is found invalid or unenforceable, that provision will be enforced to the maximum extent permissible, and the other provisions of this AGREEMENT will remain in force. No failure of either party to exercise or enforce any of its rights under this AGREEMENT will act as a waiver of such rights.
